dc.description.abstract | The aim of this research is to analyze the limits of state action, based on the perspective of political liberalism. The theme is approached from the criticism made by Robert Nozick, in Anarchy, State and Utopia (AEU), the idea of a redistributive State defended by another liberal, John Rawls. Since the defense of freedom is the foundation of liberal theories, we are interested in understanding the space that individual freedom leaves so that the democratic state of law can act without violating the private freedom of the citizen. The general objective of the research obliges us to go through themes, such as: positive freedom, negative freedom, limits of state action, social justice, free market, state intervention, social state, state restricted to security functions, among others. However, the research is limited to analyzing the topic from a moral perspective, that is, the purpose is to understand whether, contrary to what Nozick argues, it would be possible to think of a liberal state that develops social functions, without this, necessarily, morally violates the individual's private freedom. During the analysis, arguments are presented in defense of individual freedom from a conception of a redistributive State, as well as arguments in favor of a minimal state structure, restricted only to protection functions. In general, the research presents the debate carried out between the egalitarian liberalism of John Rawls, present in A Theory of Justice (TJ), and the free process liberalism of Robert Nozick. | eng |

dc.description.resumo | O objetivo desta pesquisa consiste em analisar os limites da ação estatal, tendo como base a perspectiva do liberalismo político. O tema é abordado a partir da crítica feita por Robert Nozick, em Anarquia, Estado e Utopia (AEU), a ideia de Estado redistributivo defendida por outro liberal, John Rawls. Uma vez que a defesa da liberdade é o fundamento das teorias liberais, interessa-nos entender qual o espaço que a liberdade individual deixa para que o Estado democrático de direito possa agir sem violar a liberdade privada do cidadão. O objetivo geral da pesquisa nos obriga a passar por temas, tais como: liberdade positiva, liberdade negativa, limites da ação estatal, justiça social, livre mercado, intervenção estatal, Estado social, Estado restrito a funções de segurança, entre outros. Entretanto, a pesquisa se limita a analisar o tema a partir de uma perspectiva moral, isto é, a finalidade é compreender se, ao contrário do que Nozick defende, seria possível pensar um Estado liberal que desenvolva funções sociais, sem que isso, necessariamente, viole moralmente a liberdade privada do indivíduo. Durante a análise, são apresentados argumentos em defesa da liberdade individual a partir de uma concepção de Estado redistributivo, assim como, argumentos em prol de uma estrutura estatal mínima, restrita apenas as funções de proteção. Em linhas gerais, a pesquisa apresenta o debate realizado entre o liberalismo igualitário de John Rawls, presente em Uma Teoria da Justiça (TJ), e o liberalismo de livre processo de Robert Nozick. | por |
