dc.description.abstract | This thesis is dedicated to optical mechanisms that enable the enunciation of Brazilian jurisprudence. To effectively occupy its authority position, the Brazilian Superior Court of Justice (SCJ) needs, on one hand, to remove from its visualization field the excesses and minutiae of what occurs in the “factual world”, focusing exclusively on legal arguments. To that end, the Court erects barriers to control the entry of numerous processes, but those cancels simultaneously add complexity to assessing several other factors, such as affection and intention when family case laws are at play. On the other hand, it is also pivotal that the legal arguments sustained by the SCJ are adequately disclosed to guarantee persuasive, expandable, and replicable statements. Ministers’ interpretation regarding what determines the law, once enacted, should settle as an order capable of transiting within the entire national justice system, avoiding that similar conflicts disturb ministers in further decision- making. By examining a heterogenous cluster of SCJ technical-administrative files, this thesis describes how analysts and computers, far from the ministers’ offices, take charge of comparing and compartmentalizing sentences, generating hyperlinks, and producing Mirrors and Products that are available as jurisprudence to users (i.e., the ministers themselves, lawyers, or citizens) through a digital searching engine. Enabling access to SCJ understanding is a guarantee of accessible, safe, and democratic justice. Therefore, by focusing on bureaucratic circuits and digital syntheses subsequent to the judgments of one of the most important Brazilian courts, this thesis expands the already consolidated outreach of a bibliography dedicated to the technical production of law, including its current and thorough interconnection with information technology, without which the SCJ can no longer judge. | eng |

dc.description.resumo | Esta tese é dedicada aos mecanismos óticos que tornam possível a enunciação da jurisprudência brasileira. Para ocupar efetivamente a posição de autoridade que seu nome reclama, o Superior Tribunal de Justiça precisa, por um lado, afastar de seu próprio campo de visualização os excessos e as minúcias do que acontece no 'mundo dos fatos', dedicando-se a examinar, exclusivamente, teses jurídicas. Para isso, erige cancelas que barram a entrada de grandes quantidades de processos, mas que, simultaneamente, complexificam o exame, por exemplo, do afeto e da intenção quando o que está em jogo é a definição jurisprudencial de famílias. Por outro lado e ao mesmo tempo, para que os enunciados do STJ sejam persuasivos, expansíveis e replicáveis, é imprescindível que as teses que sustentam sejam satisfatoriamente divulgadas. A interpretação dos ministros a respeito do que determina a lei, uma vez promulgada, deve sedimentar-se como ordem capaz de transitar por todo o sistema de justiça nacional, impedindo que conflitos considerados semelhantes possam voltar a importuná-los. Por meio do exame de um conjunto heterogêneo de documentos técnico-administrativos do STJ, esta tese descreve como, longe dos gabinetes, analistas humanos e computadores encarregam-se de cotejar e compartimentalizar sentenças, gerar hyperlinks, confeccionar Espelhos e Produtos que são disponibilizados como a jurisprudência
a usuários (sejam eles os próprios ministros, advogados ou cidadãos) por meio de uma ferramenta digital de busca. Tornar o entendimento do STJ visível é a garantia de uma justiça acessível, segura e democrática. Ao privilegiar os circuitos burocráticos e as sínteses digitais ulteriores aos julgamentos de um dos mais importantes Tribunais do país, a tese expande o alcance da bibliografia já consolidada que se dedica à fabricação técnica do direito, incluindo agora a sua vinculação profunda com a informática, sem a qual, argumento, o STJ já não pode mais julgar. | por |
